A federal judge has ordered the prompt release of Kilmar Abrego Garcia from detention by ICE, finding his ongoing confinement lacks legal authority.

"Since Abrego Garcia's release after erroneous imprisonment in El Salvador, he has been re-detained, again without legal justification," Judge Paula Xinis wrote in her order.

The situation originates in a mistaken deportation to El Salvador earlier this year, which the government later acknowledged was an mistake. After his return to the United States to face alien smuggling charges, he was detained in immigration detention.

In her order, the court noted that the government does not have a current removal order, which prevents them from removing Mr. Abrego Garcia "at this juncture."
